The Transport and Works Act 1992, states that it is a criminal offence for certain workers (including drivers), to work under the influence of alcohol or drugs. Under these circumstances’, if the employer has not exercised ‘due diligence’ in ensuring that the employee is not under the influence of alcohol or drugs, he or she is also guilty of a criminal offence.
